Sound like Florida's Surgeon General is controlled by his governor.

"Defendant’s threat of prosecution is not limited to the TV stations who
received the letter—it includes all “persons committing the nuisance” and
“failing to comply with notices to correct” nuisance conditions. ECF No.
1-1. Plaintiff intends to continue educating voters and promoting its ad,
and “fears that it will face prosecution by the Department, or other State
agents, if it continues” to do so. ECF No. 1-3 ¶¶ 25, 27, 31. This is
sufficient to demonstrate injury in fact.

Also goes on to note the Defendant throwing a number of irrelevant precedents
at the judge.

Footnote 4 is interesting. I leave it to y'all to read it.

Near the end:

"IT IS ORDERED:
1. Plaintiff’s motion for a temporary restraining order, ECF No. 2, is
GRANTED.
2. Defendant Ladapo is temporarily enjoined from taking any further
actions to coerce, threaten, or intimate repercussions directly or
indirectly to television stations, broadcasters, or other parties for
airing Plaintiff’s speech, or undertaking enforcement action against

DULUTH - Three men have been found guilty of raping a Duluth woman at gunpoint and forcing her boyfriend to watch before robbing the couple.

The crimes were said to have taken place at around 2 a.m. on July 21, 2021, at The Falls apartment complex in Duluth.

Police said 21-year-old Daquain R. Livingston, 20-year-old Elijah Nil Curney, 18-year-old Dashawn Andrettie Harris and a fourth already-convicted defendant found the victims parked side-by-side at the complex. They said the group pointed guns at the two of them and threatened to "blow" the woman's "brains out" if she retaliated in any way.

After the sexual attack, the defendants reportedly robbed the victims' cars while the couple ran away and called the police. Their descriptions of the suspects were corroborated with Ring doorbell camera footage from earlier that night.

DNA found in a rape kit performed on the female victim matched Curney. Police also matched fingerprints found in the cars to Harris.

Just a month later, Curney was arrested during a stop when he was found with a stolen gun in the car. Through interrogation, he partially identified the co-defendants in the case. Police were able to make the rest of the links using his phone contacts and social media.

"This is a despicable crime that absolutely could not go unchecked," Gwinnett County District Attorney Patsy Austin-Gatson said. "The trauma these defendants inflicted on the victims is unimaginable, and these three men deserve to be punished to [the] fullest extent of the law."

Livingston, Curney and Harris were each found guilty of rape, aggravated sodomy, and armed robbery.

The trio will be sentenced on Oct. 28.

The Superior Man in St. Louis County Jail on kidnapping and rape charges stemming from a Duluth incident last summer is now facing a second set of the exact same charges for a different case that happened since then. The two sets of charges are the result of an investigation into "a yearlong series of actions" taken by the suspect.

Dakota Daniel Thorestenson, 28, is being held in the St. Louis County Jail without bail, pending a court date.

Authorities are also sharing that this isn't the first time Thorestenson has faced serious charges. One case in particular - a drug-related charge - resulted in federal prison time.

In 2018, Thorestenson was convicted of "possessing more than 200 pounds of marijuana with an intent to distribute" in a case in the state of Idaho. It's due in part to the nature of that crime and the conviction, that he's not being offered bail in this case.

Both the St. Louis County Jail roster and the Superior Telegram [paywall] provide the details into the most-recent kidnapping and rape. It's worth noting that some of the details could be offsetting.

In the most-recent case, authorities allege that Thorestenson "abducted his then-girlfriend from a downtown bar, drove her to her West Duluth home and tackled her when she tried to escape". Law enforcement then alleges that the suspect "took the woman to his Superior residence, where he bound her with rope and duct tape as he beat and raped her".

The earlier case was the culmination of an lengthy investigation that the Superior Police performed at the end of last year. As part of the interview with the police, that victim shared that Thorestenson "abused her mentally, physically, and sexually while they dated". This culminated in a kidnapping from a Duluth bar in July. Once the suspect had the victim in his car, she alleges the he brought her to a dead end; she briefly escaped, but Thorestenson "tackled her" during which point she blacked out. She briefly remembers coming to a conscious state at the suspects house while he assaulted her. That assault eventually led to a rape incident, during which the victim went "in and out of consciousness". The suspect later brought her to a bathtub to "give her a cold shower to shock her body back awake". The incident culminated in a trip to the hospital, where the couple gave an excuse about "being jumped after leaving the bar".

That same victim detailed numerous other incidents that occurred during the course of their involvement.

According to the St. Louis County Jail booking information, Thorestenson faces the following current charges:

An internal review of sexual assault cases in Minneapolis turned up an estimated 1,700 untested rape kits from as far back as the 1990s — a backlog that officials say could take at least two years to clear.

The startling revelation was announced at a City Hall news conference Friday, during which department officials announced plans to hire three additional analysts to help process the forensic evidence kits.

The latest count far surpasses the 194 untested kits reported during an 2015 audit, part of what Minneapolis Mayor Jacob Frey called an "unjustified mistake" that left years of potential evidence sitting in police storage.

Speaking to reporters, Police Chief Medaria Arradondo said he had no explanation for the discrepancy in the reported numbers or why so many kits went untested, but he vowed to eliminate the backlog by working with department agencies and advocates to ensure that the kits are tested and victims are notified compassionately.

The department's sex crimes unit is still conducting a final count to determine how many kits remain, which comes amid a national reckoning over sexual harassment and assault.

"We have a failure in terms of auditing and processing that is unacceptable," Arradondo said. "I very honestly stand before you to say we still don't know why that [miscount] did occur back in 2015, but moving forward I can ensure you that it will never happen again."

He said that for the department to rebuild trust it needed to own up to its past mistakes.

Mike Sauro, a retired lieutenant who ran the sex crimes unit in 2015, defended his handling of the kits, saying a similar audit completed years ago showed far fewer. Most of the kits were deemed "restricted," meaning the victim wasn't involved in the investigation, and thus they were never sent to the state forensic lab for testing and matching against a national database of offender DNA.

"We reviewed all the kits from the year 2000 all the way up to 2015," he said in a phone interview Friday. "People have this misconception that all kits have to be and should be tested, and that's just not true. … If you don't have an official police report made, we can't enter them into the national database, so we can't test them."

Kenosha Davenport, executive director of the Sexual Violence Center, said the group will work with police and form a committee to grapple with the moral and ethical considerations that arise from reopening old cases, while avoiding retraumatizing victims.

"When you look at the span of someone's lifetime you know the healing journey isn't a linear journey, so we have victims who may not have shared with their partner or children," she said. "It's critical that the notification process is done diligently and with the support of advocates so we can continue to support them."

Denied Justice: Minnesota's failed rape investigations
Prosecutors will have to examine each case to determine whether any statute of limitations applies, said Chuck Laszewski, a spokesman for the Hennepin County Attorney's Office. Even then, he said, securing a conviction in rape cases can be challenging.

"It has always been and it continues to be a difficult crime to get a guilty verdict," he said. "There's usually only two people, there's usually not witnesses, so it can be difficult to provide enough evidence to get a jury to prove them guilty beyond a reasonable doubt."

Deputy chief Erick Fors said the untested kits were discovered in July, when the department was accounting for untested kits that need to be sent to the Minnesota Bureau of Criminal Apprehension (BCA) under state law. The kits, he said, are inventoried, sorted and maintained in police storage facilities around the city, and they're now being physically tallied to determine a final number.

All have been properly stored, he said. The department is now working with the BCA to fund additional analysts to process the untested kits, and more than 60 untested kits have already been sent to the agency, he said. "The culture has changed, and we have an obligation to test these kits," Fors said. "We're looking at some periods of time where that philosophy wasn't applied, and we really see the benefit to have this done. Hopefully this will not only result in people getting justice, but this is a debt that we owe."

The revelation of the untested kits comes one year after the Star Tribune series "Denied Justice" documented widespread failings in the investigation and prosecution of sexual assault in Minnesota and spurred changes by police departments and county prosecutors throughout the state. Minnesota police frequently struggled to investigate cases of sex assault in the years reviewed, often failing to interview witnesses, collect evidence or even assign detectives in cases in which the victim was drinking, the monthslong investigation found.

Only about one in four sex-assault reports filed with Minneapolis police is sent to the county attorney for prosecution.

The department recently has joined other law enforcement agencies around the state in taking steps to identify and process every untested kit. The department hired a victims advocate last August to work alongside investigators and help rape survivors navigate the sometimes labyrinthine process of reporting an assault.

Friday's announcement was met with frustration and condemnation in victim-advocacy circles.

Jude Foster, of the state Coalition Against Sexual Assault, said she was shocked but not surprised by the staggering number of untested kits. But she also saw it as sign that law enforcement is starting to take such cases seriously. She likened it to Detroit, where officials pushed hard to clear a backlog of more than 11,000 untested kits, subsequent testing of which identified hundreds of potential suspects.

"I felt really encouraged that the mayor of Minneapolis is taking this seriously, that the chief of police is taking this seriously. … I saw transparency and accountability today," said Foster, the agency's statewide medical forensic policy program coordinator. "That means that law enforcement is really looking at past practices, and that means that things are really starting to change."

Law enforcement agencies in Duluth and Anoka County have received federal grants to help speed their efforts to process untested rape kits and reopen cases, she said.

In a joint statement, state Reps. Jamie Becker-Finn and Kelly Moller called the city's backlog unacceptable and pledged to work with the BCA and advocates to ensure the kits are tested "as soon as possible and survivors are notified."

"These kits represent hundreds of survivors who sought justice and have gone years or even decades without receiving it," the statement read.

Under the state's rape law enacted last year, police have 10 days to retrieve unrestricted exam kits from health care facilities and 60 days to submit them for testing. They are also required, when asked, to inform victims about the status of their kits and any findings. Police are not required to test every kit connected to a reported crime, including in cases in which they think the results hold no evidentiary value, although they must explain why in writing.

A man has been sentenced for his role in a 2023 fatal shooting in Duluth.

The St. Louis County Attorney's Office announced on Tuesday that Brandon Capone Williams-Gillard, 25, has been sentenced to 40 years (480 months) after he was previously found guilty of aiding and abetting intentional 2nd-degree murder.

Williams-Gillard was involved in the fatal shooting of 19-year-old Paris Allen on Aug. 2, 2023, in an incident that left another man injured.

Williams-Gillard also received concurrent sentences of just under six years (71 months) for aiding and abetting 2nd-degree assault with a dangerous weapon and 11 years (132 months) for a drive-by shooting conviction.

Sanussi Bangoura, 22, who is also charged in the shooting, pleaded not guilty to the murder charge in February, claiming self-defense. He now awaits a jury trial, which has yet to be scheduled.

According to the criminal complaint, Bangoura and Williams-Gillard approached a man named Jackson Morales in a parking lot near 24th Avenue West and West 3rd Street. The two had a "contentious history" with Morales, charges say.

Bangoura got out of the car and hit the hood of Morales' car, proposing they "box." Morales then suggested that they do so a few blocks away.

He left the parking lot in his car, with Bangoura and Williams-Gillard following. They eventually ended up on the 2500 block of West 2nd Street.

Morales then called a group of friends to the area. He and one of his friends approached the car containing Bangoura and Williams-Gillard, with the friend then throwing a punch through the driver's side window.

The two began to drive away when Bangoura reached out of the driver's side window and began firing at the group, according to the complaint.

The man who threw the punch was shot in the buttocks and was driven to a hospital by Morales and another friend. Allen was shot in the head and was taken to a hospital by paramedics, where he later died that evening.

Police believe Bangoura fired most of the rounds.

“Our thoughts go out to the family of Paris Allen, whose life was cut short due to this senseless act of gun violence,” St. Louis County Attorney Kimberly Maki said in a statement.

“While nothing will bring Paris back, this maximum sentence makes clear that such a heinous act is not tolerated by our community.”

A warrant has been issued for a Minnetonka daycare worker's arrest after he allegedly groped a nine-year-old girl in his care over the summer.

Ryan Vaughan, 37, is charged with criminal sexual conduct for touching a child under the age of 14. Vaughan, a former employee at Tutor Time daycare in Maple Grove, has a nationwide warrant out for his arrest.

The warrant states that officers were notified on Aug. 12 about a report of a child saying they were being touched inappropriately by a teacher at their school.

Officers met with the child's parents, who said that their child goes to daycare at Tutor Time, located at 6340 Wedgwood Road North. They had noticed that her behavior had been off the past several weeks and that she was extremely anxious.

Something seemed wrong when the child's mother picked her up from school that day. After talking with her child, she learned that Vaughan had been grabbing the girl's thigh and buttocks.

The warrant states that the child was taken to CornerHouse to be interviewed on Aug. 14, and said he would grab her thigh and butt. The child said Vaughan told her not to tell anyone, and despite telling him to stop, he wouldn't listen.

According to the child's account, she had been touched multiple times over the course of that last week.

Vaughan has been in and out of the court system, dating back as early as 2005. While most have been traffic misdemeanor convictions, he had been previously charged in Otter Tail in 2005 for a 5th-degree domestic assault case.

He was eventually convicted on disorderly conduct after pleading guilty, having the other charge dismissed. He served a total of 90 days in jail, and one year of probation.

Charges were filed against Vaughan on Thursday, and he has not been arrested yet.

Bring Me The News has reached out to Tutor Time in Maple Grove and received a statement from a spokesperson, confirming that Vaughan had worked there since June 2024, but has since been terminated.

"Immediately upon learning of the allegations, the staff member was placed on administrative leave," the spokesperson said. "Following our protocols, we reported the matter to the appropriate authorities and have provided our full cooperation when contacted regarding their investigations. The employee has since been terminated."

Additionally, they said required background checks were run on Vaughan, including reviewing state-maintained abuse registries, but nothing was revealed "that would preclude his employment or raise red flags."

According to the Department of Human Services (DHS), Tutor Time's Maple Grove location has been the subject of multiple corrective actions dating back to 2020.

Most recently, in February 2024, more than a dozen violations were found within the facility during a licensing review, including an individual who was required to have a background study before being allowed contact with children. The center was also not clean, and the staff was unaware of children's allergies.

Prior violations from earlier visits also state that staff did not supervise the children at all times, and there were multiple instances of children being given "prohibited disciplinary actions." According to its website, all of the violations brought forth by DHS have been corrected and approved by the department.

Hennepin County Prosecutors charged two sisters for their roles in the fatal hit-and-run crash that took the life of Andre Steward.

“God-fearing man, always had his bible everywhere he went,” said the victim’s sister, Leah Anderson.

Steward was a grandfather and father who loved God, golf, and basketball, according to his family.

At the end of August, arrest warrants were issued for the driver, 25-year-old Victoria N. Yorahee of Mesa, Arizona, and her sister, 18-year-old Tianna R. Yorahee of Minneapolis.

Hennepin County Court documents said the victim’s family reported to authorities that the driver. “…has been harassing…” their family “by phone and social media… saying she will never be caught.”

“I made a post on Facebook that went viral about my dad getting killed,” said Clarissa Riley, the victim’s daughter.

Riley said afterward, several family members started receiving information about the crash from a variety of people.

Back on the night of July 29th, a church’s security camera captured Steward, 52, riding his motorized scooter home when he was struck by an SUV at Fremont and 22nd Avenue North in Minneapolis. According to police, the SUV was going about 80 miles an hour before the crash on the city street.

Witnesses told police that several women got out of the SUV, and the driver pulled off the rear license plate before running away.

“To me, that was so, not human, no morals, no respect, just totally cold,” said Anderson.

Steward was injured and trapped under the SUV. He later died days later at the hospital from his injuries. One of the women charged, Victoria Yorahee is now listed in a Dallas, Texas jail roster being held for criminal vehicular homicide on a Hennepin County warrant.

The second suspect, Tianna Yorahee, has an active arrest warrant for “aiding an offender.”

Arrest warrants have been issued for two sisters who allegedly fled to Las Vegas after causing a fatal hit-and-run in Minneapolis in July.

Victoria Nevada Yorahee, 25, and Tianna Renee Yorahee, 18, both of Arizona, are on the run in connection with the death of 52-year-old Andre Stewart on July 29.

Stewart was on a motorized scooter at Fremont Avenue North and 22nd Avenue North when he was struck by a Nissan Pathfinder that was allegedly traveling at around 80 mph on a residential street.

Stewart died from his injuries. Victoria, who was allegedly the driver, has been charged with two counts of criminal vehicular homicide, and Tianna is charged with aiding and abetting criminal vehicular homicide.

The complaint says that when officers arrived at the scene around 9:25 p.m., they saw the car without license plates stopped a half block south of the intersection on Fremont Avenue North.

The SUV's hood was open and flipped back onto the windshield. Both front doors were open, and the airbags were deployed. The front end of the Nissan SUV was lifted off the ground and resting on top of the motorized scooter.

Stewart was lying in the road with multiple injuries and covered in blood. He was taken to North Memorial Hospital by ambulance, but died on August 2.

Officers were able to confirm the car belonged to Victoria after recovering a phone and paperwork inside the crashed SUV.

Witnesses at the scene saw Victoria and Tianna exit the SUV with another woman who has not been identified. They saw the women remove the rear license plate and run away, as well as throwing away several liquor bottles into some nearby bushes, which witnesses showed officers later.

A text conversation earlier that same day between Victoria and Tianna showed that Victoria texted about wanting to “hit the wood,” a slang term for smoking marijuana. A video taken that same day was taken from the driver’s seat of the Nissan SUV, looking out of the front windshield.

A couple of weeks after the accident, Stewart's adult daughter told officers she had information about Victoria being the driver and that she fled with her sister to Las Vegas.

According to the complaint, the daughter said Victoria was harassing her by phone and social media, saying she would never be caught and that she would get pregnant to avoid going to prison.

Since the crash, Stewart's daughter has been actively trying to get justice for her father on Facebook.

Another witness from Las Vegas had contacted the Stewart family after meeting the two sisters, who were introduced to him by a business partner because the sisters wanted help.

He met the sisters at a restaurant in Las Vegas, where Victoria allegedly admitted to driving drunk and striking Stewart before fleeing the scene and buying a ticket to Las Vegas with her sister.

She then showed this witness some Facebook posts from the victim's family about the incident, bragging about how she reported the post and got it taken down.

He was bothered by both their admissions and lack of remorse. When he told Victoria to call the police, she refused.

A GoFundMe was created in Stewart's honor by his family to raise money for his funeral expenses.

"Our dad was a loving and caring person who touched the lives of many. He always put others first and was a pillar of strength for our family," the GoFundMe reads. "We want to give him the memorial he deserves, to honor his memory and say our last goodbyes."

The sisters' whereabouts are currently unknown.

4 A few “limited categories of speech are traditionally unprotected—obscenity,
fighting words, incitement, and the like.” Honeyfund.com, Inc. v. Governor, 94
F.4th 1272, 1277 (11th Cir. 2024) (quoting Brown v. Ent. Merchs. Ass’n, 564 U.S.
786, 791 (2011)). “But what counts as unprotected speech starts and ends with
tradition—‘new categories of unprotected speech may not be added to the list by
a legislature that concludes certain speech is too harmful to be tolerated.’ ”
Id. But Defendant has not demonstrated that the political speech at issue falls
within any of these categories. It is not commercial speech subject to a more
relaxed standard permitting some government regulation, nor is it obscene, nor
is it inciting speech that will imminently lead to harm to the government or the
commission of a crime.

Defendant argues this is dangerous and misleading speech that could cause
pregnant women harm in Florida. But there is no “general exception to the First
Amendment for false statements.” United States v. Alvarez, 567 U.S. 709, 718
(2012) (plurality opinion).

Falsity alone does not bring speech outside the First Amendment absent some
other traditionally recognized, legally cognizable harm. Id. at 718–722. That is
because “it is perilous to permit the state to be the arbiter of truth.”
Alvarez, 567 U.S. at 752 (Alito, J., dissenting).

Defendant seeks to fit a square peg into a round hole by suggesting that
Plaintiff’s speech is unprotected because it poses an “imminent threat” to
public health. But this argument fails too.
Speech is unprotected as an “imminent threat” when it incites or produces
imminent lawless action, or poses a clear and present danger by bringing about
the “substantive evils” that the government has a right to prevent, like
obstacles to military efforts, obscenity, acts of violence, and charges to
overthrow the government. Brandenburg v. Ohio, 395 U.S. 444, 447 (1969); Near v.
Minnesota
ex rel. Olson, 283 U.S. 697, 716 (1931). But there is no suggestion that
Plaintiff’s ad would bring about the “substantive evils” that the Supreme Court
has recognized, nor is there any suggestion that Plaintiff’s ad would cause
individuals to take any imminent lawless action.

fund specific literature/documents where public
funds and institutions are involved. If you WANNA
