A Winona Senior High School teacher and coach is accused of having sexual relationships with three students who told investigators they confided in him with personal issues, new criminal charges allege.

Eric D. Birth, 29, is facing a dozen counts of third-degree criminal sexual conduct in connection with the investigation, which found he allegedly had three separate relationships with students ranging in age from 16 to 18.

Birth, who was placed on administrative leave early last month, has worked for Winona Area Public Schools since 2016, including as a high school physical education teacher during the 2021-2022 school year, court records show.

The following is a breakdown of each criminal complaint.

Victim 1
According to the criminal complaint, police began investigating Birth in June of 2023 upon receiving a report of a relationship between Birth and an 18-year-old senior.

The victim initially denied the allegations, saying Birth was her track coach "and nothing more," charges state.

In early January, the woman contacted police and said she'd lied during the previous interview.

Speaking to investigators, the woman alleged Birth started a Snapchat group with her and other girls who ran for the track team. After awhile, Birth removed himself from the group and later provided her and one of the other girls in the group his personal phone number to text.

Charges say on April 24, 2022, the woman was cited for texting Birth while driving. After the traffic stop, she said she went to meet Birth, who got into her vehicle to talk.

According to the complaint, Birth then kissed her, "which she said made her feel uncomfortable."

At one point, Birth is accused of making the teenager participate in a sexual act, stopping only due to a car approaching. She said she refused further advances from Birth, but he later tried to persuade her to have a relationship with him.

Victim 2
On Jan. 18, a second victim contacted police regarding Birth.

According to the complaint, investigators met with the victim who claimed to have a sexual relationship with Birth while she was a 16-year-old student and Birth was her track coach.

The victim claims the two "flirted" over text which later led to sexual acts, including intercourse, in the summer of 2016.

Victim 3
Police were first notified about a third victim of Birth's misconduct by witnesses.

One member of the track team said she'd seen a video on Birth's phone involving a third victim and Birth engaged in a sexual act, charges allege. Another witness confirmed also seeing the video.

After initially denying the claim, the victim spoke to investigators Jan. 31.

According to the complaint, the woman confirmed she was in a sexual relationship with Birth, which included intercourse, while she was on the track team in April and May of 2017. She was 17-years-old at the time.

The woman said she received a call during her senior year from Birth, warning her she would likely receive a call from the high school regarding their relationship.

She told police her mother was sitting next to her during the subsequent call from the school principal, so she denied the relationship.

Birth is charged with four counts of 3rd-degree criminal sexual conduct in three separate cases. If convicted on all counts, he faces up to 60 years in prison and a $120,000 fine.

Birth is next scheduled to appear in court on Thursday, Feb. 22.
