An election integrity watchdog warned Tuesday that mental, physical, and
even �continence� problems may prompt Democrats to switch out President
Joe Biden with an alternative, possibly Hillary Clinton, on the
presidential ticket.

The Oversight Project, a legal arm of the Heritage Foundation, cited
several reasons why it believes Biden�s days are numbered and said the
Thursday debate between Biden and former President Donald Trump could be
make-or-break for the Democrat.

The group said it is not going to stand by if the White House or
Democratic Party tries to override state election laws to insert a Biden
replacement. In fact, it is already laying the groundwork for �pre-
election litigation� to block that.

�We're kind of sounding the alarm,� said Mike Howell, executive director
of the Oversight Project. �This could get really messy."

Several Democrats have reportedly urged Biden to consider stepping aside
for another candidate. Biden has refused and shows no signs of backing
out.

Democratic voters in polls have also shown a desire for a younger
candidate who can tackle Trump�s candidacy and even a third of Democrats
told a Rasmussen Reports survey this week that Biden should be replaced if
he loses the Thursday debate.

Recognizing the growing anti-Biden trend among Democrats, Howell issued an
�emergency� memo last week warning about a possible move. He noted that
since Biden has already passed through the primary process and beyond fall
election ballot deadlines, the party is stuck with the president.

But clearly, he said in a conference call with the media today, the
Democrats don�t agree. He noted recent moves by Clinton to get back into
the presidential mix.

Clinton today released the cover of her upcoming book and said it would
include an unknown political warning. She has recently emerged as a
regular Biden surrogate.

In making his case for why Biden could step aside, Howell cited several
examples of the president�s personal problems, from freezing at a South
Lawn Juneteenth celebration to wandering off stage at the G7 in Italy. He
also referenced social media posts about Biden and continence problems.

�You've seen the discussions that are going on across the country, whether
it's the freezing episodes, the perpetual gaffes, and obviously another
major theme is the perceptions of the continence issues which are, I
think, really taking hold. And at some point, you know, the political
burden of all these episodes is going to come to bear,� Howell said.

His memo warned that making a switch legally will be difficult � and will
be challenged.

�Policymakers and the public should be prepared for all externalities that
arise from President Biden not running for president in 2024. The process
for substitution and withdrawal presents many election integrity issues.
Adherence to the law in some states may result in that process being
unsuccessful for the purposes of another candidate being on the ballot,�
his memo for the Oversight Project said.

A federal judge on Monday rejected the latest attempt by President Joe Biden's son Hunter Biden to dismiss several tax-related charges he faces in Los Angeles, all but ensuring that the case will go to trial as scheduled early next month.

In July, attorneys for Hunter Biden filed a pair of motions seeking to dismiss his cases in both California and Delaware, citing a decision by a federal judge in Florida to dismiss the classified documents case against former President Donald Trump.

But on Monday, U.S. District Judge Mark Scarsi, the Los Angeles-based federal judge overseeing the tax case, denied that bid, concluding in a seven-page ruling that his attorneys' arguments failed on both procedural and factual grounds.

Scarsi, in denying the motion, cited Hunter Biden's previous ill-fated efforts to dismiss the case.

"As he concedes in his notice of the motion, Mr. Biden plainly seeks reconsideration of issues already decided upon his February motion," Scarsi wrote, concluding that "there is no valid basis for reconsideration of the court's [prior] order denying Mr. Biden's motion to dismiss the indictment."

The judge, however, determined that Hunter Biden will not face sanctions after Scarsi earlier threatened to sanction him after Hunter Biden's attorneys suggested in court filings that special counsel David Weiss only brought the charges after he was elevated to special counsel. Biden's legal team acknowledged in a subsequent filing that their claim had been "inartfully" articulated.

Democratic National Committee delegates on Monday evening by voice vote adopted the party's 2024 platform at their convention, a document that echoes President Joe Biden more than Vice President Kamala Harris and contains no call for an arms embargo on Israel as pro-Palestinian delegates and some uncommitted delegates had wanted.

The full, 92-page draft platform, unveiled by the party late on Sunday night, was written before President Joe Biden left the 2024 race, and was voted upon by the DNC's Rules Committee in July.

It has not been updated significantly since Harris replaced him at the top of the ticket.

Biden is mentioned 287 times in the platform, while Harris is mentioned 32 times.

An 80-year-old grandmother in Washington state died during a carjacking this week as she struggled to protect two dogs, and a 48-year-old suspect is in custody for what police are calling a senseless killing.

The Seattle Police Department identified the victim as Ruth Dalton, a local dog walker. One dog in the car with her at the time belonged to Dalton and was later found fatally stabbed, police Deputy Chief Eric Barden said during a press conference Wednesday.

The suspect was arrested later that night by a SWAT team, Barden said, and when captured, he was carrying a bloody knife and the keys to Dalton’s Subaru.

“This is a tragic and horrific incident,” Barden said. “(Dalton was) participating vibrantly in her community... that was snatched from her and from her family and her friends and the community by virtue of this senseless violence.”

Police identified the homicide suspect to USA TODAY as Jahmed K. Haynes, of Seattle.

A motive in the killings was not immediately known, but police told USA TODAY Haynes has eight prior criminal convictions including a vehicular homicide in 1993, and Barden said the suspect has a history of mental health issues.
