Georgia Election Rule Prompts Concerns of Chaos and Delays

election board is facing backlash after passing a rule that opponents say
will insert chaos into the coming election. The board agreed Tuesday on a
new definition of election certification, requiring �reasonable inquiry�
before local election supervisors sign off on the final results. The move
adds uncertain discretion�and potential delays�into what has been a
largely formulaic step in the long election process. �It looks more like a
power grab rather than an effort to improve elections,� said Megan
Bellamy, vice president of law and policy at the nonpartisan group Voting
Rights Lab. Supporters of the measure argue giving election supervisors
investigatory powers at that stage is intended to add more transparency to
the election process. Former President Donald Trump�s unsubstantiated
claims that the 2020 election was stolen from him has found a sympathetic
ear with three members of the Georgia election board, which voted 3 to 2
to pass the measure. The trio have courted controversy in recent months
for secret meetings and claims of partisanship. At an Atlanta rally
Saturday, Trump praised them by name for their work. �Three members�Janice
Johnston, Rick Jeffares, and Janelle King�three people are all pit bulls
fighting for honesty, transparency and victory,� the Republican nominee

seen in the crowd smiling and waving from a row of seats just in front of
the stage. The former president faces state prosecution on charges of a
criminal conspiracy to subvert the outcome of the 2020 election through
Georgia election officials. Trump denies wrongdoing. On Jan. 2, 2021,
then-President Trump urged Republican Brad Raffensperger, Georgia�s
secretary of state, to find enough votes to overturn the election. Trump
has since criticized Raffensperger of party disloyalty. Raffensperger was
ousted from any control of the board after an overhaul of the system
post-2020 and has previously called the state�s board �a mess.� �Georgia�s
Election Integrity Act requires counties to certify the election results
by November 12 and we fully anticipate that counties will follow the law,�
said Mike Hassinger, spokesman for the secretary of state�s office, on
Wednesday. Critics of the new Georgia election rule say that it violates
existing state law. The law is �unambiguous� on how to certify, according
to Georgia State University law professor Anthony Michael Kreis. �The
State Election Board is trying to provide a new investigatory tool not

largely a math problem�officials confirm to the state they have recovered
and counted all valid ballots, they have allowed voters to cure problems
when allowed and the tallies add up. The process isn�t a recount. In the
case of a numerical discrepancy�such as more votes are counted than
registered voters in the precinct or if one candidate receives more votes
than were cast�officials can review on a narrow basis, Georgia law says.
�While the board can promulgate rules to make it easier for local
officials to carry out their duties in a uniform way, it cannot confer
additional authority on local elections to do things they are not already
empowered to do,� said Kreis. Tuesday�s eight-hour election-board meeting
was characteristic of its typical proceedings, including back-and-forth
comments between members, fiery public comment and admonitions from the
board chair after some speakers were interrupted. �It�s the duty of the
boards to provide oversight in a fair and reasonable way,� said Johnston,
the board member Trump praised on Saturday, in defense of the rule. SHARE

after three of her colleagues approved the measure, prompting King, seated
to her left, to shake her head and say �Sara,� while chuckling. The
microphones didn�t pick up the entirety of their ensuing interaction, but
one final disagreement from Ghazal could be heard. �No,� she said. �We
just broke the law.� There are fewer than 90 days left until the
presidential election. Last-minute changes to election procedures are
frowned upon by the courts, but the exact definition of how soon is too
soon would be up to a judge in the case the rule is challenged via lawsuit
before November. Eleventh-hour changes can cause �chaos and confusion,�
according to Bellamy at the Voting Rights Lab. �There are teams of local
election officials working together to make sure that the elections run
without any big mistakes and that they run as securely, accessibly and
fairly as possible for November. A big part of our focus is making sure
that their job isn�t made to be any harder than it already is,� she said.
Opponents of the new election certification definition worry that without
clarity it could lead to different interpretations in different
jurisdictions of �reasonable inquiry.� Board Chair John Fervier, an
appointee of Georgia Republican Gov. Brian Kemp, who voted against the
measure, said he would not support the change without �guardrails� around

the board the Georgia General Assembly has had plenty of chances to revise
the certification definition. �Dozens if not hundreds of election statutes
have been proposed, considered, many have passed,� said Georgia Rep. Saira
Draper, whose district includes Atlanta. �If we wanted to make election
certification a discretionary duty of our election superintendents, we
would have done so, but we didn�t. �With all due respect, the board does
not have the authority to override the decisions that the duly elected
members of the General Assembly have made.� Michael Heekin, a Republican
member of the Fulton County election board, proposed the state rule
change. �What we are doing is very important and it�s not to be taken
lightly,� Heekin told the state board on Tuesday. �You have to look, how
was the election run? Were there problems? Was it a carefree election or
was it snakebit?�

Presidency; Threats Against Former Presidents; and Certain Other Secret
Service Protectees
The Counterterrorism Section of the National Security Division has
supervisory authority over 18 U.S.C. §§ 871 and 879 cases. As great
caution must be taken in matters relating to the security of the persons
protected by 18 U.S.C. § 871, United States Attorneys are encouraged to
consult with the Counterterrorism Section (CTS) of the National Security
Division when they have doubts on the prosecutive merit of a case. For
the same reason, dismissal of complaints under 18 U.S.C. § 871, when the
defendant is in custody under the Mental Incompetency Statutes (18
U.S.C. §§ 4244, 4246), requires approval from CTS. In other cases,

PHOENIX –David Michael Hanson, 41, of Phoenix, was arrested on Wednesday
for making online threats against the President and Vice-President.
Hanson was charged by Federal criminal complaint on Tuesday with five
counts of Threats Against the President and Successors to the Presidency
and five counts of Interstate Communication of Threats.

The complaint alleges that in November and December of 2023, while
living in Arizona, Hanson used a social media platform to post threats
to murder the President and Vice President of the United States. On
November 19, 2023, Hanson posted online a series of threatening
statements including one that stated, “#joeAndKamala I’m asking you to
resign on Monday your alternative is death brutally murdered.” After the
U.S. Secret Service spoke to Hanson and warned him that it was a Federal
crime to post such threats, on December 23, 2023, Hanson posted another
series of similar threats aimed at the President and Vice-President.

Each count of Threats Against the President and Successors to the
Presidency carries a maximum sentence of five years in prison, a fine of
up to $250,000, and up to three years of supervised release. Each count
of Interstate Communication of Threats carries a maximum sentence of
five years in prison, a fine of up to $250,000, and up to three years of
supervised release.

A complaint is simply a method by which a person is charged with
criminal activity and raises no inference of guilt. An individual is
presumed innocent until evidence is presented to a jury that establishes
guilt beyond a reasonable doubt.
