As they should be. We don't reward criminals engaged in criminal activity.

However, if they leave the country, wait 90 days, and the apply for a work
visa absent any other crime, I would feel that to be an acceptable
compromise.

I would also note that we need to make a major revision to our procedures to
get a work visa.. frankly, it's much to hard currently.

Easy.. They self deport, then apply for entry at the border and a work visa.
if they reenter during this period (90days) then they are barred from the
program.

Wouldn't be an ideal solution, but one I could live with.

Side note: we need to revamp the guest worker program and make it easier to
obtain the visa for such workers. Even if only issuing a temporary permit in
the interim

I think what he's trying to say, is that the current program makes it too
hard, to expensive and to long to get such a permit even if you are a
suitable person with jobs waiting to be done.

I see time ranges to get such a visa from 2 weeks to 7 months and have heard
of people trying to get them for over a year or more.

Certainly we can improve on this, and for a plan like this to work, we would
need to.

If we want them to be documented and legal to work then we need to insure
it's reasonable possible to do so. Yes, there will be exceptions in some
cases, but in general we should be able to do better.

Not totally, most I've talked to would simply require they first leave the
country and then reapply for a work visa and entry. I think were most oppose
the general idea is when we reward them while in violation of our laws.

Yes, it would be a PITA for them to do this.. but seems like a small price
to pay for their crime up to this point in order to become legal.

Only if the amnesty is granted. Further given Mexico's neutral status, I'm
not sure an entry from Mexico would really count as they have already
escaped their issues when they entered Mexico... however, that's not a hard
and fast rule, but in general that should apply.

No if they want a work visa.. rather than refugee status, that would be a
lot easier and they could do that while we consider any application for
refugee status.
