It's not "tresspassing" <guffaw>, and it is not any crime at all.

As a general rule, it is not a crime for a removable alien to remain
in the United States.

United States Supreme Court - Arizona v. United States
https://www.law.cornell.edu/supremecourt/text/11-182

Note that the statute on unlawful presence provides for *no* incarceration or
other criminal penalties:

https://www.law.cornell.edu/uscode/text/8/1227

The most that can happen is the alien may be deported.

Improper entry is a crime, but it is a commonplace that the large majority of
aliens who are unlawfully present did *not* commit improper entry. They entered
the country entirely properly and legally on valid visas, then failed to leave
on or before the expiration date of their visas.

Unlawful presence is not a crime.

Nope. Congress is not going to pass a law to criminalize unlawful presence. This
is settled.

You said unlawful presence was going to be criminalized. Now you're changing the
subject.

You don't know who or where they are.

No, how how you got here can certainly be a crime and your unlawful presence
here defacto proof of your crime(s). Which can include up to 10 years in
jail per federal law.

> Just wait and see. That's going to change.

Yep, Given the level of visa overstays, as supported above, clearly jail
time should be a consideration as well as monetary penalties.

Funny that illegal aliens who do this get kicked out and it's 1-10 years
before they can legally re-enter the US.

That is assuming they haven't robbed, raped or killed anybody yet.

It is not. You have to prove beyond a reasonable doubt in court;
and the defendant has a right to free defence counsel if they
cannot afford their own. What if I claim I was kidnapped into the
USA? The burden of proof is on you.

Deportation is not a criminal punishment. That is why we have
immigration courts that are far cheaper than article 3 courts. How
much in taxes are you willing to pay for your wet dream?

And you are still an idiot.

We'll simply cut funding for the welfare those illegal spics and their families
consume, as well as funding for tranny operations.

That's the *definition* of a visa overstay, o oozing scarlet red maxipad (whose

I do know what it means, o oozing scarlet red maxipad ( whose mouth waters at
the thought of his mommy's warm mackerel-reeking snatch). And I know that it is
not limited to *only* violations of criminal statutes. It includes violations of
civil provisions of the law, o oozing scarlet red maxipad ( whose mouth waters

No, scooter. Someone who entered the country legally at a port of entry and with
